The meeting convened at 6:00 pm.

2. Kaminstein – 18 Woodland Dr. – SMA NOI – SMA06-12 – Construction of single family house and septic on property with greater than a 15% grade. (Lovett)
Represented byShannon Fields of White Engineering and house designer, Paul Clark. Judy Kaminstein present.
Applicants proposed a stabilization plan for the grade. Drawing reference ll/06/06. Final changes drawing 01-09-08C: Five areas designated for planting. Presented a planting plan for designated areas. Wetland will be replaced with wetland plantings. Two paths proposed: one 12 ft wide path to dock and a 6 ft wide path to swimming area. They want to trim down 8 ft. high shrubs when they block the view to 3 or 4 ft. high. Taking out two trees for parking area.
Because applicants are in the wetlands, CC approved the reconstruction of the retaining wall.
Conditions of the work in relation to wetlands:
There is to be no encroachment into the wetlands.
They will not be able to trim or perform any activity in relation to new or current growth.
Once the house is removed, approved plants must be planted in that space, allowing wetlands to resume unfettered activity.
Silt fence must be installed before and after house comes down that will stay up until surrounding ground is stabilized.
No refueling within 50 ft. zone.
The plantings: Refer to White Engineering letter dated October 24 ‘06.
Applicants will protect the 4 hemlocks on the SE side of existing bldg.
The wetlands are to be bounded by metal markers to prevent future encroachment into buffer zone.
An iron marker must be installed indicating 50’ buffer zone.
Applicant shall record the location of the buffer zone and the wetland in the registry.
Paths must have some kind of vegetation.
Applicant should come before CC around any issue of tree trimming in the future.
Sequence of the work:
House removal first,
Wall removal second
House construction.
Before well is dug, applicants need to show that the slurry pit is between the well and the property line. Shannon will contact well driller to show CC a plan before the slurry pit is dug.

3. Kaminstein – 18 Woodland Dr. – WPA NOI 230-0233-Demolish existing single family house and construct new house in buffer zone to Lake Garfield (Lovett) – need a planting plan.

Misc.
1. Craig-Okerstrom Lange and Mrs. Dolber were present to respond to their enforcement order. She had to leave before CC could meet with her.
2. Received a complaint for no wetlands filing for the Alpert house from contractor who was working on a house next door. CC discussed the violation for Alpert and the Kelley violation.
3. Re Lombardo residence on Mr. Hunger Rd, CC agreed that there should be three trees
planted to screen each corner of the house.
4. Carol deHarak on Hupi Rd: Silt fence has been taken down. Site inspection made on Sept. 11 and all the work has been done. No ongoing conditions. Approved for Certificate of Compliance.
5. Ahye revised plans: CC reviewed the change in septic system, conducted a site inspection last month and found the requested change acceptable. Melissa to send a letter to them approving changes shown on site development plan #03-11-06D dated 7/28/06.
6. ZBA application for Brenner – 42 Elephant Rock Rd. Letter to ZBA about Brenner:
“We reviewed the paperwork submitted for the ZBA petition. The Brenner project applied to CC under SMA and Wetlands Protection Act. With appropriate conditions we were able approve the project. We see no conditions in the proposed project that would prohibit approval.”
7. Paul Geall: Send same letter to ZBA.
8. Greenwald project on 6 Point Rd. We approved the project on March 06. Chris recused himself.
9. Reviewed mail.
